Terms of Service

These Terms of Service ("Terms") govern access to and use of the Flowion platform (the "Service"), operated by Flowion AB, a company registered in Sweden under organization number 559453-0155 ("Flowion", "we", "us"). By creating an account, signing an order form referencing these Terms, or otherwise using the Service, the organization on whose behalf you act ("Customer", "you") agrees to be bound by them.
If you're using the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms.
The Service#
Flowion is a multi-tenant platform for managing EV charging infrastructure over the OCPP protocol — connecting chargers, running charging sessions, and providing a management API and dashboard for Customers to operate their own fleets.
Accounts and users#
- Customer's authorized individuals ("Users") access the Service through accounts tied to Customer's organization. Customer is responsible for the actions of its Users under the Service and for keeping its organization's membership and access up to date.
- Customer must provide accurate information when setting up its organization and keep it current.
- Customer is responsible for maintaining the security of its Users' credentials and for promptly notifying us of any unauthorized access.
Customer data#
- As between Flowion and Customer, Customer retains all rights to the data it submits to or generates through the Service — charger configuration, charging session records, and any other data associated with its organization ("Customer Data").
- Flowion processes Customer Data only to provide the Service, as described in our Privacy Policy, and, where Customer Data includes personal data of Customer's own end users (e.g. EV drivers), as a processor acting on Customer's instructions.
- Customer is responsible for ensuring it has the necessary rights and legal basis to submit any personal data to the Service, including data about its own end users.
Fees and payment#
Fees for the Service, if any, are set out in an order form or separate written agreement between Flowion and Customer. Where fees apply, they are due as specified in that agreement; late payment may result in suspension of access to the Service after reasonable notice.
Acceptable use#
You agree not to use the Service to:
- Violate any applicable law or regulation
- Interfere with or disrupt the integrity or performance of the Service, including other Customers' use of it
- Attempt to gain unauthorized access to the Service, other Customers' data, or the infrastructure it runs on
- Reverse-engineer, resell, or sublicense the Service except as explicitly agreed in writing
We may suspend access if we reasonably believe these Terms are being violated, and will make reasonable efforts to notify Customer first unless doing so would create a security risk.
Chargers and third-party hardware#
The Service communicates with EV charging hardware over the OCPP protocol. Flowion doesn't manufacture, sell, or control that hardware, and isn't responsible for a charger's physical operation, safety, or compliance with electrical or other regulatory standards — that responsibility sits with the hardware and its operator. Correct behavior of the Service depends on a charger implementing OCPP correctly; we're not liable for issues caused by a charger's non-compliant or unexpected behavior.
Service availability#
We aim to keep the Service reliably available but don't guarantee uninterrupted or error-free operation. Planned maintenance, third-party infrastructure issues, or circumstances outside our reasonable control may affect availability. Any specific uptime commitment applies only if separately agreed in writing with Customer.
Intellectual property#
Flowion and its licensors retain all right, title, and interest in the Service, including its software, design, and documentation. These Terms grant Customer a limited, non-exclusive, non-transferable right to use the Service for its own internal operations — nothing here transfers ownership of the Service to Customer.
Confidentiality#
Each party may receive confidential information from the other in connection with the Service. Each party agrees to protect the other's confidential information with the same degree of care it uses for its own confidential information, and not to disclose it except as needed to perform under these Terms or as required by law.
Term and termination#
- These Terms apply for as long as Customer maintains an account or an active order form with Flowion.
- Either party may terminate for the other's material breach that isn't cured within a reasonable period after written notice.
- On termination, Customer's access to the Service ends. We'll retain Customer Data only as described in our Privacy Policy, and will make reasonable efforts to give Customer an opportunity to export its data before deletion where practicable.
Warranty disclaimer#
The Service is provided "as is" and "as available." To the extent permitted by applicable law, Flowion disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability#
To the extent permitted by applicable law, Flowion's total liability arising out of or related to the Service is limited to the fees Customer paid to Flowion in the twelve (12) months preceding the event giving rise to the claim. Neither party is liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, or data, except in cases of gross negligence, wilful misconduct, or where such limitation isn't permitted by applicable law.
Governing law and disputes#
These Terms are governed by the laws of Sweden, without regard to its conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be settled by the general courts of Sweden, with the Stockholm District Court (Stockholms tingsrätt) as the court of first instance.
Changes to these Terms#
We may update these Terms from time to time. We'll update the "Last updated" date above when we do, and for material changes affecting an active Customer we'll make reasonable efforts to provide notice before they take effect.
